This SMS Messaging Policy governs how Guard Direct, LLC (“Guard Direct,” “we,” “us,” or “our”) sends text (SMS) messages to users, guards, customers, and contacts who have opted in to receive such communications. This policy is designed to comply with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and Twilio's Acceptable Use Policy.

1. Program Description

Guard Direct uses SMS messaging to support operations and communications for security companies using our platform. SMS messages may include:

  • Shift scheduling notifications and reminders for guards
  • Real-time alerts (geo-fence violations, missed checkpoints, incidents)
  • Account-related notifications (password resets, login codes)
  • Responses to demo request form submissions
  • Platform updates and critical service announcements
  • Optional promotional messages for existing customers who have opted in

2. Opt-In Requirements

Guard Direct will only send SMS messages to individuals who have provided express consent. Opt-in methods include:

  • Platform registration: When guards or administrators create an account and provide a phone number, they are informed that SMS messages may be sent for platform operations. Explicit consent is obtained during setup.
  • Web form opt-in: Individuals who submit a demo request or contact form may check an opt-in checkbox to receive SMS communications. The checkbox is unchecked by default.
  • Verbal opt-in via phone: Individuals who provide verbal consent during a sales or support call.

Opt-in is voluntary. Declining SMS messages will not affect access to the Guard Direct platform or your ability to receive service support via other channels.

3. Message Frequency

Message frequency varies based on your role and account activity:

  • Guards: Up to 5–10 messages per day during active shifts (shift start/end, checkpoint reminders, alerts)
  • Supervisors and administrators: Varies based on operational events and alert configurations
  • Sales and marketing messages: No more than 4 messages per month for individuals who have opted in to marketing communications
  • Transactional messages: Triggered by specific account events (e.g., login codes, password resets) — frequency depends on user activity

4. Message and Data Rates

Message and data rates may apply. Standard carrier messaging rates apply to all SMS messages sent and received. Guard Direct does not charge additional fees for SMS delivery. Please consult your mobile carrier for details about your messaging plan and applicable rates.

5. How to Opt Out (STOP)

You may opt out of Guard Direct SMS messages at any time:

  • Reply STOP to any SMS message from Guard Direct to immediately unsubscribe from all text messages.
  • After replying STOP, you will receive a single confirmation message: “You have been unsubscribed from Guard Direct SMS messages. You will not receive further texts. For help, contact (720) 336-2411.”
  • Opting out of SMS will not affect your platform access or other communication methods.
  • If you are a guard receiving operational messages through your employer's Guard Direct account, contact your employer to adjust operational notification settings.

7. Phone Number Privacy and Data Sharing

We do not sell, rent, share, or trade your phone number with any third party for their marketing purposes.

Your phone number may be shared only in the following limited circumstances:

  • SMS delivery providers: We use Twilio, Inc. as our SMS delivery service provider. Twilio processes phone numbers solely to deliver messages on our behalf and is bound by strict confidentiality and data protection agreements.
  • Within your organization: Account administrators in your company may see phone numbers associated with guards under their account.
  • Legal compliance: If required by law, court order, or regulatory requirement.

Phone numbers collected for SMS messaging are used exclusively for the purposes disclosed at the time of opt-in.

8. Supported Carriers

Guard Direct SMS messages are delivered via major U.S. carriers including but not limited to: AT&T, Verizon, T-Mobile, Sprint, US Cellular, and regional carriers. Carrier support may vary. Guard Direct is not responsible for delays or non-delivery caused by carrier networks.

9. Record Keeping

Guard Direct maintains records of SMS opt-in consent, including:

  • Date, time, and method of opt-in
  • Opt-in disclosure language presented at the time of consent
  • Opt-out requests and confirmation timestamps

Records are retained for a minimum of 4 years for compliance purposes.

10. Compliance

Guard Direct's SMS messaging practices are designed to comply with:

  • Telephone Consumer Protection Act (TCPA)
  • CAN-SPAM Act (where applicable)
  • CTIA Messaging Principles and Best Practices
  • Twilio Acceptable Use Policy
  • Applicable state laws governing electronic communications and consumer protection

11. Changes to This Policy

We may update this SMS Policy to reflect changes in our practices or applicable law. Material changes will be communicated to affected users before taking effect. Continued use of our SMS services constitutes acceptance of the updated policy.
